1. Acceptance of Terms By accessing or using the JawCheck application, operated by VitalOrtho (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.
2. Not Medical Advice (Important Disclaimer) JawCheck is an educational and informational screening tool designed to help you track, organize, and communicate your TMJ symptoms. JawCheck does not provide medical diagnoses, treatment plans, or professional medical advice. * Always seek the direct advice of your dentist, physician, or other qualified healthcare provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay in seeking it because of something you have read or generated on this application.
- Not for Emergencies: This app is not intended for use in medical emergencies. If you are experiencing a medical emergency, please call 911 or your local emergency services immediately.
3. ChatTMD and Artificial Intelligence JawCheck includes an AI-powered assistant (“ChatTMD”). You acknowledge that ChatTMD generates responses based on patterns in data and is not a human healthcare professional. While we strive to provide helpful and holistic educational information, AI-generated content may be incomplete or inaccurate. You agree not to rely on ChatTMD for medical decision-making.
4. User Responsibilities
- You must be at least 18 years old to use this application, or have the consent of a parent or legal guardian.
- You agree to provide accurate, current, and complete information regarding your symptoms and medical history.
- You are responsible for maintaining the confidentiality of any login credentials used to access the app.
- You agree to use the app only for its intended, lawful purpose.
5. Privacy and Data Your use of JawCheck is also governed by our Privacy Policy, which outlines how we securely collect, use, and protect your health and biometric data. By using the app, you consent to our data practices as described in the Privacy Policy.
6. Limitation of Liability To the fullest extent permitted by law, VitalOrtho and Dr. M. Azadeh Afzali shall not be liable for any direct, indirect, incidental, consequential, or medical damages resulting from the use or inability to use the JawCheck application, your reliance on ChatTMD outputs, or from any clinical decisions made by your healthcare provider based on the app’s summary report.
7. Modifications to the Service VitalOrtho reserves the right to modify or discontinue, temporarily or permanently, the JawCheck application (or any part thereof) with or without notice.
